Welcome to Side Brain. These Terms & Conditions apply to your use of sidebrain.net and purchases of our classes, private sessions, workshop recordings, and digital products.
In these Terms, “Side Brain,” “we,” “us,” and “our” refer to the business providing these products and services. “You” and “your” refer to the customer or website user.
Please read these Terms before purchasing. By placing an order, you agree to the Terms presented at checkout. Nothing in these Terms limits consumer rights that cannot legally be excluded.
1. Products and Services
Side Brain offers live Music Production Study Group workshops, recorded workshops, private Ableton sessions, and digital products. Digital products may include Max for Live devices, Live Extensions, presets, samples, guides, project files, and other music production resources.
The relevant product page describes what is included, the price, and any applicable requirements. A recorded workshop purchase does not include admission to a future live workshop unless expressly stated.
2. Purchases and Customer Information
Please provide accurate contact and payment information. We use the email address supplied during checkout to send receipts, download instructions, and information about your purchase.
If you enter an incorrect email address or do not receive an expected message, contact info@sidebrain.net so we can help verify your order and correct the issue.
Purchasers must be at least 18 years old. A parent or legal guardian must arrange purchases and provide consent for a participant under 18.
You may be able to purchase without an account. If you create an account, keep your login details secure and notify us promptly if you suspect unauthorized access.
3. Prices and Payments
Prices and any applicable taxes or discounts are shown before you place your order. Payments must be successfully completed before access to paid products or services is provided.
We accept the payment methods displayed at checkout. Payments are handled by third-party payment providers and are subject to their applicable terms.
Promotions and bundles apply only to the eligible products and conditions stated in the offer. A discount on recorded workshops does not include live tickets or private sessions unless expressly stated. Any refund will take account of the amount actually paid for the affected purchase, including applicable discounts, subject to law.
4. Live Study Group Workshops
Your live Study Group ticket covers the session described when you purchase. Unless the product page states otherwise, it includes the live workshop, its recording, class notes, and associated downloads.
Zoom links are emailed approximately one hour before the workshop starts. The recording, notes, and downloads are normally shared the following day. We will notify you if delivery is materially delayed.
Please check your inbox, spam, and promotions folders. If your Zoom link has not arrived about one hour before the workshop, contact info@sidebrain.net.
Session times are stated in Pacific Time unless otherwise indicated. Please check the corresponding time in your location, including daylight saving changes.
Tickets and Zoom links are for the registered participant. Do not share access links or admit other participants without permission.
5. Private Ableton Sessions
Submitting a booking request does not guarantee a particular date or time. Private sessions are confirmed by email, and payment should be made after that confirmation.
Your confirmation email and the relevant product page describe the agreed session length, format, price, and included materials. Refer to our email conversation for your confirmed date, time, and joining instructions.
Please arrive on time and have the necessary software, equipment, and internet connection ready. If you arrive late, we may still need to finish at the originally agreed time.
Contact us as soon as possible if you need to cancel or reschedule. Requests are handled individually, subject to availability and any cancellation policy expressly agreed before payment. Any cancellation or no-show fee must have been disclosed and agreed before payment and must comply with applicable law.
6. Workshop Recordings and Digital Downloads
Download or access instructions are sent to the email address used at checkout after successful payment. Check the product page for the included files, supported software versions, operating systems, and other requirements.
You are responsible for having the required software and equipment. Ableton Live, Max for Live, third-party plugins, and other software licenses are not included unless expressly stated.
Keep a backup of downloaded files. If a download link fails or a file appears missing or damaged, contact info@sidebrain.net for assistance.
Any access period, download limit, included support, or update entitlement will be stated with the product. Future features or compatibility with software versions released after purchase are not promised unless expressly stated or required by law.
7. Cancellations, Credits, and Refunds
Live Study Group tickets
We generally offer credit toward a future Study Group workshop instead of a change-of-mind refund. Contact us to arrange a transfer or discuss a missed session. The recording and included materials remain part of your original ticket unless we agree to transfer the purchase to another session.
Recorded workshops and digital products
Because these products are delivered digitally, we generally do not offer change-of-mind refunds once access has been supplied, except where required by law.
This does not affect your rights if a product is defective, materially different from its description, or not delivered. Contact us so we can investigate and provide an appropriate remedy, which may include a working replacement, a correction, or a refund.
Private sessions
Cancellation and rescheduling requests are handled as described in Section 5 and any policy agreed before payment.
Cancellations or significant changes by Side Brain
If we cancel a paid session, we will offer a replacement session, credit, or a refund for the affected service. If we substantially change its date or time and you cannot attend, contact us to arrange an appropriate alternative or refund.
Statutory consumer rights
All policies above are subject to applicable consumer law. Where a statutory withdrawal right applies to digital content, immediate supply and any loss of that right require the consent and acknowledgment required by law. Accepting these general Terms alone does not replace any separate consent required for that purpose.
If you notice a duplicate charge or another billing error, please contact info@sidebrain.net. This does not restrict your rights through your payment provider or under applicable law.
8. Permitted Use and Intellectual Property
Side Brain and its licensors retain ownership of their teaching materials, recordings, software, and other content. Your purchase grants permission to use the purchased material under the applicable license; it does not transfer ownership of its intellectual property.
Workshop recordings and teaching materials are for your own learning. You may apply the techniques you learn in your own music, including commercial projects. You may not share, upload, resell, or redistribute the recordings or teaching materials without permission.
The permitted use of included samples, presets, project files, software, and other assets is governed by the license provided with that product. Do not assume that every sound or third-party work demonstrated in a workshop is cleared for commercial reuse. Where no license is stated, contact us before redistributing an asset or incorporating supplied third-party material into a commercial release.
You retain ownership of your original music and projects. Sharing them for instruction or feedback gives us permission to use them as necessary to provide that service, subject to any separately agreed recording permissions. It does not give us a general right to publish or promote your work.
Reviews or comments submitted for public display may be displayed in their intended context. We will seek separate permission before using private submissions, session footage, or your projects in promotional materials.
9. Session Recordings and AI Summaries
Live workshops and private sessions may be recorded as described in the relevant offering. Before recording, we will explain the intended use and obtain any consent required by law.
Group workshop recordings may be shared with attendees and made available for purchase. Depending on how you participate, a recording may include your voice, camera image, display name, chat contributions, or screen-shared content. Please avoid sharing confidential material or content you do not have permission to share.
Private-session recordings are intended for the client and will not be published or sold without separate permission.
Where AI transcription or summarization is used, we will disclose that use before it begins. AI-generated notes may contain errors and should be checked against the session itself. Contact us before the session if you have concerns about recording or AI processing so we can discuss available arrangements.
10. Email Communications and Privacy
We send emails needed to fulfill your purchase, including receipts, download instructions, Zoom links, and scheduling updates.
Newsletter enrollment is optional and separate from accepting these Terms. You can unsubscribe from marketing emails using the link in those messages. Unsubscribing from marketing does not prevent us from sending necessary communications about your purchases or booked sessions.
Our Privacy Policy explains how we collect, use, and protect personal information, including our use of service providers.
11. Participation, Technical Issues, and Support
Please treat other participants respectfully. Harassment, disruptive conduct, unauthorized sharing of access, and misuse of the website or its services are not permitted.
You are responsible for preparing your equipment and connection. If a technical problem on our side prevents delivery of a paid session or product, we will work with you on an appropriate remedy. If a problem occurs on your side, contact us promptly so we can discuss the available options.
We may remove a participant or restrict access where reasonably necessary to address a serious violation of these Terms. Any consequences for paid purchases will be proportionate and remain subject to applicable law.
12. Disclaimers and Liability
Our products and teaching are intended to support your music production practice. We do not guarantee a particular creative, educational, professional, or financial result.
Third-party platforms and software may experience outages or changes outside our control. This does not remove our responsibility to provide the products and services you purchased or any remedy required by law.
To the extent permitted by applicable law, Side Brain is not liable for indirect or consequential losses arising from use of the website, products, or services. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or any other liability that cannot legally be excluded or limited.
13. Changes, Governing Law, and Contact
We may update these Terms and will display the revision date above. The Terms accepted when you purchase govern that purchase unless a change is required by law or you expressly agree otherwise. Material changes affecting ongoing services will be communicated where required.
These Terms are governed by applicable United States federal law and California law, subject to any mandatory consumer protections and rights to bring claims in your local jurisdiction that apply to you.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
